The current paper explores the application and revision process of the Acquired Rights Directive in the context of insolvency proceedings, focusing on the role of community and national (British and Italian) case law. It therefore analyzes, from a comparative perspective, the inevitable conflict between hese disciplines, and the related implementation of the EU Directive in Italy and in the United Kingdom.
